After the U.S. Citizenship and Immigration Services (USCIS) approves the I-129F, Petition for Alien Fiancé, the following activities will take place:
-
USCIS Will Notify the U.S. Petitioner/Citizen
USCIS will send the I-797, Notice of Action notifying the U.S. citizen that the petition was approved. If you have an attorney, your attorney will also receive a courtesy copy of the approval notice.

-
USCIS will send a notice to the National Visa Center (NVC). The NVC will send you and/or your attorney with a notice on how to proceed with obtaining a K-1 visa.

-
Eventually, your fiancé will have to complete the DS-160: Online Nonimmigrant Visa Application and submit required documents. After the DS-160 is submitted, your fiancé can schedule a visa interview online.
-
Your fiancé will visit a U.S. consulate or embassy abroad (in his or her country) and apply for a visa. Having the USCIS approval notice is not a guarantee that your fiancé’s visa application will be approved. Instead the consular officer will review the previously filed K-1 petition and screen your fiancé.
If you are a client at the Law Office of David Nguyen, PC, we will send a consular packet to your fiancé to help him/her with the visa interview. The consular packet will contain documents and instructions that will help the consular officer process the case.
